By purchasing, installing, or using this product, you expressly acknowledge and agree to the following terms and conditions:

  1. Assumption of Risk
    You understand and voluntarily accept all risks associated with the installation, use, or misuse of this product. Activities involving this product may be inherently dangerous and may result in property damage, serious injury, or death. You assume full responsibility for any such risks, whether foreseeable or not.

  2. User Responsibility
    This product is intended for use only by individuals with the proper skill, experience, and physical condition to safely operate and maintain the equipment it is used with. Improper installation, use, or maintenance may result in hazardous conditions or equipment failure. It is your responsibility to ensure correct setup and adherence to all safety protocols.

  3. Waiver of Liability
    To the maximum extent permitted by applicable law, Trim X Performance, its owners, employees, agents, affiliates, and distributors shall not be liable for any loss, damage, injury, or death to any person or property resulting from the use or misuse of this product. This includes, but is not limited to, claims based on negligence, product failure, or improper use.

  4. No Warranty of Fitness or Safety
    This product is provided โ€œas is,โ€ with no representations or warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or safety under specific conditions.

  5. Insurance and Warranty Disclaimer
    Use or modification of this product may void or alter your vehicleโ€™s or equipmentโ€™s factory warranty or your insurance coverage. It is solely your responsibility to consult with your manufacturer and insurance provider prior to use.

  6. Indemnification
    You agree to indemnify and hold harmless Trim X Performance from and against any and all claims, losses, damages, liabilities, legal fees, or expenses arising from your use or misuse of the product.

  7. The Buyer agrees to only use the product in a way that is consistent with the lawsย  in the jurisdiction that the product is being used in ie Queensland.

    The Buyer agrees to indemnify and hold harmless the Seller, its officers, employees, agents, and representatives (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with a

    (a) any failure to use the product to in accordance with applicable laws, regulations, or standards in the jurisdiction where the product is used;

    (b). Any injury, death, or property damage caused by the product, except to the extent that such injury, death, or damage is caused by the negligence or wilful misconduct of the Indemnified Parties.

    This indemnity shall be governed by and construed in accordance with the laws of Queensland and the parties submit to the non-exclusive jurisdiction of the courts of Queensland

    Nothing in this clause shall limit or exclude any liability that cannot be limited or excluded under applicable law.
